Cases of Desert at the time of death

1) The widow:

    The widow deserves a share in the salary. This will also include the divorced wife (revocable divorce) if the husband died during the Iddat period.

2) The husband:

The husband deserves a share in the salary if he is incapable of gaining money.

3) The Sons:

     The son deserves a share in the salary in the following cases:

a- If he is incapable of gaining money whatever was his age.

b- If he is a student in one of the education stages which are not higher than the secondary education provided that he does not exceed 28 years old.

c- If he is holder of a university degree, its equivalent or more provided that he has not reached 28 years old and he is working or practicing an activity submitted to the provisions of the Fifth Chapter of the Social Insurances law.

4) The daughters:

The daughter deserves a share in the salary if she is not married (never married before, divorced or widow) whatever was her age at the time of the death

5) The father:

     The father deserves a share in the salary if he was dependent for living on the insured person or the owner of the salary during the lifetime of the son.

6) The mother:

    The mother deserves a share in the salary if she is a widow or a divorced person.

7) The brother:

   The brother deserves a share in the salary of his deceased brother ,if he was dependent on him for a living, and if he meets the same conditions of the son.

8) The sister:

     The sister deserves a share in the salary of her deceased brother if she is not married (never married before, divorced or widow) and she is dependent on him for a living.

9) The sons and daughters of the child:

     The sons and daughters of the child who satisfy the desert conditions of the sons and daughters, deserve the share of their father if he was dead or died after deserving the salary and his share was not finished.
